Simon Guobadia is still behind bars in an ICE detention center. His divorce from Porsha Williams has not been finalized, so federal agents will reportedly take him to his upcoming divorce hearing. The update comes after he missed his last court date. Porsha is fighting to enforce the prenup they signed before tying the knot. But with Simon still locked up, finalizing the process has been delayed.

Simon Failed To Appear At His Recent Divorce Hearing

Porsha has made it clear she’s not playing when it comes to the prenup she and Simon signed before marriage. According to In Touch, the ‘Real Housewives of Atlanta’ star and her attorney attended a court hearing concerning the agreement at Fulton County courthouse on Wednesday, April 30. But Simon was nowhere to be seen because U.S. Immigration and Customs Enforcement is currently detaining him.

Simon’s legal team did notify the judge ahead of time that their client would not be able to attend due to his current circumstances. But the hearing still went ahead on Thursday, May 1. Porsha and her attorney were present, though the matter couldn’t go anywhere since her estranged husband was absent.

Consequently, the judge presiding over the case has reportedly scheduled a new hearing for June 11 to enforce the agreement the pair signed. And since Simon is required to attend, ICE federal agents are expected to transfer him from custody to the courthouse.

The Judge Reportedly Ordered Him To Be In Attendance For The Next Court Date

The judge has reportedly issued a production order, which allows Simon to attend his new court date by temporarily leaving ICE’s detention center. “Counsels for [Simon] indicate that the ICE agency has advised that upon receiving a production order, arrangements will be made to transport [Simon] to physically appear in Court at the Fulton County courthouse,” the judge said.

Additionally, if Simon gets out of ICE custody before the hearing and can’t make it in person, he must give the court a heads-up. That way, they can plan to have the hearing take place remotely instead.

“[Simon] should provide this court with as much advance notice as possible to allow this court to make arrangements for the hearing to occur via remote proceedings, and the parties and counsel may attend the hearing remotely,” the judge added

Here’s Why Simon Is Contesting The Prenup

The Nigerian businessman initially opposed the prenuptial agreement with Porsha, citing misrepresentations and nondisclosures. He claimed Porsha concealed her plan to return to ‘The Real Housewives of Atlanta,’ leading him to believe she would be a stay-at-home mom. Additionally, he alleged spending over $2 million on their extravagant wedding and accused Porsha of filing for divorce to trigger the prenup’s provisions.
